1. About These Terms

These Terms and Conditions ("Terms") govern your use of the ShipTo platform ("Platform", "Service", "Website") operated by Welcome Associated Services Limited trading as ShipTo ("we", "us", "our").

By accessing or using ShipTo, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform.

2. Definitions

Platform/Service/Website:
The ShipTo online marketplace accessible at shipto.uk and related domains
Customer/User:
An individual or business posting a transport or delivery job
Transporter/Provider:
A registered member offering transport services and bidding on jobs
Job/Listing:
A transport or delivery request posted by a Customer
Bid/Quote:
An offer from a Transporter to complete a Job for a specified price
Transaction:
The agreement between a Customer and Transporter for a specific Job

3. ShipTo's Role

ShipTo is a marketplace platform only. We provide an online venue connecting Customers with Transporters, but we are NOT:

  • A transport company or broker
  • A party to transactions between Customers and Transporters
  • Responsible for the quality, safety, or legality of any transport services
  • Liable for actions, omissions, or representations of Customers or Transporters

All transactions are made directly between Customers and Transporters. ShipTo facilitates the connection but bears no responsibility for the execution or outcome of any Job.

4. Eligibility and Registration

To use ShipTo, you must:

  • Be at least 18 years old
  • Be capable of forming legally binding contracts under applicable law
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Not have a previously suspended or terminated account

Each account is for a single user. Sharing login credentials is prohibited. You are responsible for all activity under your account.

5. Platform Access

We strive to keep ShipTo available 24/7, but we do not guarantee uninterrupted access. The Platform may be unavailable due to:

  • Scheduled or emergency maintenance
  • System failures or technical issues
  • External factors beyond our control
  • Updates or improvements to the service

We reserve the right to suspend, modify, or discontinue any aspect of the Platform without notice. We are not liable for any loss or inconvenience resulting from Platform unavailability.

6. Prohibited Activities

You must NOT:

  • Post false, misleading, or fraudulent information
  • Use the Platform for unlawful purposes or to transport illegal goods
  • Share contact information before a bid is accepted (see specific terms)
  • Attempt to bypass ShipTo's platform or payment systems
  • Post threatening, obscene, defamatory, or harmful content
  • Transmit viruses, malware, or other harmful code
  • Harass, abuse, or threaten other users
  • Use automated systems (bots, scrapers) without permission
  • Create multiple accounts to circumvent restrictions
  • Copy, modify, or redistribute Platform content without authorization

Violations may result in account suspension or termination, and we reserve the right to cooperate with law enforcement.

7. Intellectual Property

All content on ShipTo, including text, graphics, logos, images, software, and design, is owned by ShipTo or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view and download Platform content for personal, non-commercial use only. You may NOT:

  • Modify, reproduce, or distribute Platform content
  • Use ShipTo branding without written permission
  • Reverse engineer or extract source code

8. Privacy & Data Protection

Your use of ShipTo is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with UK GDPR and Data Protection Act 2018.

By using the Platform, you consent to our data practices as described in the Privacy Policy.

9. Disclaimers & Limitations of Liability

The Platform is provided "as is" without warranties of any kind.

To the maximum extent permitted by law, ShipTo disclaims all warranties, express or implied, including:

  • Accuracy, reliability, or availability of the Platform
  • Quality or suitability of transport services
  • Credentials, qualifications, or conduct of users
  • Fitness for a particular purpose

Limitation of Liability: ShipTo is NOT liable for:

  • Loss or damage to goods during transport
  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Actions or omissions of Customers or Transporters
  • Disputes between Customers and Transporters

Our liability cannot be excluded for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under UK law

10. Indemnification

You agree to indemnify and hold harmless ShipTo, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your interactions with other users
  • Any content you post or transmit

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Repeated complaints from other users
  • Non-payment of fees
  • Any reason at our sole discretion

Upon termination, your right to use the Platform ceases immediately. Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination.

12. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use after changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.
